These Terms of Use ("Terms") govern your access to and use of the Meshtrack platform, the Orbit mobile app, the Meshtrack website at meshtrack.co.za and any related service (collectively, the "Service") provided by Sethala (Pty) Ltd.
By creating an account, installing the Orbit app, or otherwise accessing the Service you agree to be bound by these Terms. If you disagree with any part, you may not use the Service.
By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, you may not access the Service.
Some features of the Service require registration. When you register you agree to provide accurate, current and complete information, and to safeguard the credentials you use to access the Service. You are responsible for all activity under your account.
User responsibilities
When using the Service you agree to the following.
You are responsible for reasonable security measures to protect your data and the devices accessing the service — strong passwords, up-to-date software, secure networks and standard IoT-device hygiene.
You agree to use the service in compliance with all applicable laws and regulations — including data-protection, privacy, intellectual-property and export laws.
You may not use the service:
- ·For any illegal purpose or in violation of any law
- ·To infringe the intellectual-property or other rights of any third party
- ·To transmit viruses, malware or any destructive code
- ·To harass, abuse, harm or impersonate any person
- ·To submit false or misleading information
- ·In any way that could disable, overburden, damage or impair the service
Data, privacy and processing
Our Privacy Policy describes how we handle the personal data you provide and the data we collect through the Service. By using the Service you consent to processing in accordance with that notice.
Data may be stored and processed on servers in South Africa and other jurisdictions. By using the Service you consent to transfer of information to locations outside your country of residence, which may have different data-protection rules. We will continue to apply our ISO 27001-aligned controls regardless of where the data lives.
Intellectual property
The Service and its original content, features and functionality are and remain the exclusive property of Sethala (Pty) Ltd and its licensors. Meshtrack, Orbit, Zone Track, IDLINK and Tracepoint are trademarks of Sethala (Pty) Ltd. The Service is protected by South African and international copyright, trademark and other intellectual-property laws.
You retain all rights to content you submit, post or store via the Service — including the floor plans, anchor positions, tag inventory, asset records and event history of your tenancy. By submitting this content you grant Sethala a limited, worldwide, royalty-free licence to use, reproduce and process it strictly as needed to operate the Service for you.
Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason — including (without limitation) breach of these Terms. Upon termination your right to use the Service ceases immediately. If you wish to terminate your account you may stop using the Service and notify us to delete it.
Provisions of these Terms which by their nature should survive termination — including ownership, warranty disclaimers, indemnity and limitations of liability — will survive.
Limitation of liability
To the maximum extent permitted by law, neither Sethala (Pty) Ltd nor its directors, employees, partners, agents, suppliers or affiliates will be liable for any indirect, incidental, special, consequential or punitive damages — including loss of profits, data, use, goodwill or other intangible losses — arising from your access to or use of (or inability to access or use) the Service.
Changes to these terms
We may modify or replace these Terms from time to time. Where a change is material we will give at least 30 days' notice before the new terms take effect. What counts as a material change is at our reasonable discretion. Your continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
